Monmouthshire, as agent for the constituent authorities of the Cardiff Capital Region City Deal, are awarding a works contract for the specialist fit out of clean rooms and foundry capacity installation suitable for the manufacture of advanced compound semi-conductor technologies at the former P&T factory in Newport, Gwent. IQE Plc, as the management consultant, and its sub-contractors, are the only contractors with the technical capability to meet the requirement to provide the specialist clean-room fit out and foundry installation required for the manufacture of compound semi-conductors within the requisite time frame, being July 2017. The fit out for compound semi-conductors is different to conventional silicon technologies. Therefore, as a global leader in compound semi-conductor technology, IQE is uniquely positioned to oversee this project, with the detailed works being performed by specialist sub-contractors. The time frame is necessary to secure the expansion of compound semi-conductor manufacturing in Wales as part of the regions commitment to the development of a compound semi-conductor cluster in South Wales, and to meet the timelines demanded by product launches in the end market. This accords with our interpretation of Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015. Monmouthshire intends to enter into the contract with IQE Plc 10 days following publication of this notice.

Explanation:

Monmouthshire, on behalf of the Cardiff Capital Region City Deal, intends to award this works contract direct to IQE Plc (‘IQE’) as there is an absence of competition due to technical reasons. As a global leader in compound semi-conductor technology, IQE is uniquely positioned to oversee this project, with the works being performed by specialist sub-contractors. It is imperative that the works commence in July 2017 in order that the facility is available to house production in early 2018, which is essential if South Wales is going to be in a position to secure expansion opportunities in the end market.

A suitable location has been identified in Newport, Gwent. IQE has previously worked with two sub-contractors, Atkins Group and CMB Engineering Ltd, to provide a similar fit out for the manufacture of compound semi-conductors at IQE's premises in Cardiff. IQE required to provide training to the two sub-contractors over a 19 month period to equip the sub-contractors with the necessary skills to fit out the IQE premises in Cardiff.

From recent non-related procurement exercises for similar fit out works, Monmouthshire are aware that at present only IQE, Atkins and CMB have the requisite skill to provide the required fit out of clean rooms and foundry installation for CSC manufacture within the time-scales required.

As only IQE and the two sub-contractors will be capable of providing the required fit out service within the time available, there is a lack of alternative capacity capable of undertaking the works within the time-scale necessary. Monmouthshire rely on the lack of competition due to technical grounds to make the award of the contract in line with Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015.
